Carrier IQ found engaged in illegal wiretapping activities on smartphones – Part 2

The information derived from devices is encrypted
and secured within our customer’s network or in our audited and customer-approved facilities.”
According to Ohm, Carrier IQ’s first line of defence will be to take cover behind some sort of a clause in one of the contracts of subscription signed by the users that allows reconnaissance to some length in order to keep tabs on quality of service by the
network carriers.
However, Ohm mentioned that Eckhart has noticed obscure activities when he turned the phone to Flight Mode.
When a phone is in Flight Mode, it does not use the GSM or LTE services. When Eckhart connected the phone to his WiFi network, the same log was seemingly maintained whilst the use of email services or browsing of web.
“I don’t understand how my phone on my own wireless network is their service, and how they have the right to look at that.”
These kind of activities were observed on Android-based HTC phones, Nokia’s Symbian-operated E and N-series and RIM’s Blackberry smartphones.
“This seems like really intrusive, comprehensive surveillance,” Ohm reiterated. “If so, is there really a provision in the contract that’s so all-encompassing? They may say they’ll periodically monitor for quality assurance or something to that effect. But
that seems like a far cry from saving every keystroke.”
Carrier IQ tried to discredit Eckhart’s research in the start but after Electronic Frontier Foundation stepped in, they backed off and apologized to the Connecticut-based tech expert.
Now that the cause is backed by EFF, it is speculated that this will be taken to the court. Eckhart’s legal representation has already confronted CIQ at EFF’s forum. However, Eckhart and company remained of few words on the legality of Carrier IQ’s business
practices.
