Apple wins another infringement case against HTC’s Android-based smartphones – Part 2
Tuesday, December 20th, 2011 3:09:17 by Usman KhalidAccording to HTC, this function had been in Blackberry and other smartphones before iPhone had even surfaced in the market.
They said in the official statement: “Our own layman assessment of the feasibility of such a work around is also very straight forward: it is very easy, best proof being that Blackberry users have been able to call a number that is part of the body of an
email since before the iPhone existed,” he writes. “We therefore firmly believe this ruling will represent absolutely no disruption at all to HTC’s business in the U.S.”
HTC being the humble opponent in the case won a lot of sympathies from tech experts and customers all around the world. Many regard this loss as actually HTC’s win in a way. Confessing the mistake and acknowledging the warning made them exactly the opposite
of what comes out of the defence table.
One expert promptly favoured HTC in this particular case: “Many observers will hastily claim this is a victory for Apple, we believe the exact contrary. HTC and Android won this first battle. This ruling is very disappointing to the Cupertino firm, in the
sense that only 2 claims relating to only one patent have been recognized as true by the ITC, out of dozens relating to 10 patents that formed the initial filling of Apple. It is also disappointing in the sense that it won’t disrupt at all, at least in our
analysis, HTC’s and Android’s business.”
HTC claimed that they will find another way around the dialling feature from text and will launch the new Ice Cream Sandwich phones safe from infringements.
