The politics in Pakistan witness unique type of experiences in every changing day. In a recent move, the former JUI-F senator, Azam Swati, filed a petition with the Supreme Court, demanding a travel ban for President Asif Ali Zardari.
Swati filed the petition with the apex court through his counsel Tariq Asad under Article 184(3), asking to put Zardari’s name on Exit Control List (ECL).
Article 184(3) of the Constitution reads; “Without prejudice to the provisions of Article 199, the Supreme Court shall, if it considers that a question of public importance with reference to the enforcement of any of the Fundamental Rights conferred by Chapter
I of Part II is involved have the power to make an order of the nature mentioned in the said Article”.
The petitioner prayed before the court to constitute a high-level probe commission to investigate the inglorious memogate scandal.
To further mess the already degenerated situation, Swati made President Asif Ali Zardari, Army Chief through the military secretary, Hussain Haqqani, Salman Farooqui, Mansoor Ijaz, ISI Director Ahmed Shuja Pasha, and the federation through the Secretaries
Foreign Affairs and Interior, respondent in the petition.
Quoting the story published in the New York Times, a US newspaper, the requester observed that president came back for a short time only to attend the death anniversary of his wife and two-time former premier, Benazir Bhutto.
A few days ago, NYT carried out a news item that stated, “President Asif Ali Zardari’s return to Pakistan from Dubai could be just a cameo appearance before his wife and former prime minister Benazir Bhutto’s death anniversary on December 27, 2011 and after
that he would probably leave for a long convalescence in London or Dubai, he would probably leave for a long, perhaps permanent convalescence in London or Dubai”.
The applicant prayed before the court that the memogate scandal was a serious issue that raises questions about the national integrity of the country. In his view, the presence of Asif Ali Zardari in the country is significant, considering the worth of the
case.
Tariq Asid stated that the president should not be allowed to go abroad until the case gets resolved. He also asked the Supreme Court to summon complete electronic record of responsible officials, especially, Hussain Haqqani, Farahatullah Babar and Salman
Farooqui.
The Swati’ counsel asked the court to formulate a high-level commission, comprising of reputed officials, to probe the matter.
