Peshawar: (Tuesday, December 27, 2011) While expressing judiciary’s resolve to protect democratic system in Pakistan, Peshawar High Court Chief Justice Dost Mohammad Khan said yesterday that judiciary was to protect democratic
system at all costs, however, the government too should serve the people who have born great hardships.
“Even the worst democracy is better than the best dictatorship. The country will finally get true leadership free of corruption after the gradual process of weak democratic system as witnessed in Europe and USA,” the chief justice
stated in his address to a Peshawar district bar ceremony arranged in his honour for becoming the PHC chief justice.
He said there was no outcome of political speeches as there was need for practical work. The rulers should strengthen democratic system and give rights to the deserving, he added. He said due to the decision of the Supreme Court’s
larger bench headed by Chief Justice Iftikhar Muhammad Chaudhry, no judge in future could play a role for undemocratic acts in the country.
About the ratio of cases filed against both the federal and provincial governments and departments, the PHC chief justice said a few days ago he saw a record of cases and 40 percent were filed against them.
“The 40 percent cases against the government shows a painful situation. The record showed that the government officers were not performing duties and the people and government employees were forced to go to the courts for seeking justice,” the chief justice
said.
“Today everyone is knocking at the door of judiciary for getting rights and justice. This shows people’s trust in judiciary and decrease in performance of the government departments,” the chief justice added.
Strictly warning the corrupt judges, the chief justice said: “I am giving a short time to subordinate judges involved in corruption to reform themselves and stop corruption or be ready for strong action.”
He said he had started talks with the provincial government for bringing about a positive change in the judicial system and was hoping to bring revolutionary changes within a year.
“I had called meetings of sitting and ex-cadre judges and directed them to follow merit in cases and deliver decisions in accordance with law, constitution and rules and regulations,” he said, adding that everyone was equal in
the law.
