Peshawar: (Friday, December 30, 2011), While persuading with murder case of Alamzeb, the brother of alleged rape victim Uzma Ayub, the Peshawar High Court (PHC) yesterday included Section 7 of Anti-Terrorism Act (ATA). While doing
so, the court rejected the findings of the report by Deputy Inspector General (DIG) Police Inquiry and Inspection about the murder as it felt he had given under favour to the police.
A two-member bench comprising Chief Justice Dost Muhammad Khan and Justice Waqar Ahmad Seth, taking suo moto notice of the murder of Alamzeb, observed that the first inquiry about the murder conducted by the DIG Police Inquiry
and Inspection, Sultan Hanif Orakzai was totally baseless as he didn’t even record a single statement and gave a clean chit to all the police officers and constables who were present when the brutal murder took place.
However, the bench appreciated the second inquiry by a high-level team headed by DIG (Investigation) Mohammad Idrees Khan and observed that his probe and the inquiry conducted by the Additional Secessions Judge Takht Nusrati were 99 percent similar with regard
to the murder case.
In these inquiries police officers and constables present on the spot were held responsible for the murder and their suspension from service was recommended. The bench directed the provincial government to continue both the inquiries – one about the kidnapping
and rape of Uzma Ayub and another into the murder of Alamzeb by a high-level team headed by DIG Idrees Khan.
The bench directed that both cases should be transferred to the Anti-Terrorism Court in Kohat once the investigation was completed. The court directed that both cases should be investigated by the DSP and his team within the shortest possible time in a fair
manner. The bench directed the secretary home, inspector general of police (IGP) and district and sessions judge Karak to supervise the inquiries. The bench also directed the director general, Health Department to conduct DNA test after delivery of the child
to confirm its father so that the rapist is brought to justice.
The court rejected the inquiry committee report’s recommendation that the DNA test be carried out before the birth of the child. IGP Muhammad Akbar Hoti appeared in the case and informed the bench that he had acted on the court’s directives in the case. He
said the policemen present at the time of the murder were suspended and some arrests had also been made. However, he did not respond to questions raised by the chief justice about the police violations of duties and law. The chief justice observed that he
had two videos of police lawlessness in two murder cases including one regarding the murder case of Alamzeb and another about a man killed by the police in Swat district.
