It seems that a resistless forces and an unbending object have now taken positions to face-off. The incumbent PPP-led government is the unbending object while the Supreme Court is the resistless forces in the present scenario.
The apex court has done everything with sneaking, as the incumbent failed to implement order of the Supreme Court in the case of the National Reconciliation Ordinance (NRO).
In a recent move, the apex court instead of releasing any orders for fulfillment observed that it would take direction action against those who are delaying the process without considering their positions and official statuses.
The issue is about a letter that was supposed to have been dispatched to the Swiss officials but it was oddly blocked in the system. In a virtuosity show of legal periphrasis, Attorney General Maulvi Anwarul Haq argued that the said letter could not being
dispatched because of the review petition.
Furthermore, he prayed before the court that the government could not file answer in this regard as right person, the law secretary, was abroad.
It is unclear that what was obstacle to the onwards travel of the Swiss letter might be, as the review petition has been dismissed long ago. The incumbent government has not slightest wish to dispatch the letter to anywhere other than the trash can.
The nonappearance of law secretary is telling a different story. He failed to appear before the court previously despite court’s summons. It simply tells us that he didn’t prepare a summary for the premier for dispatch to Switzerland.
It is vital to note here that the previous summary was just a statement of position rather than an implementation of the SC’s ruling.
A government, which has as much investment in the rule of law as do turkeys in the Chrisms season, revealed when its style is being loosened.
The government is defying the superior judiciary with silly moves just because the former’s rulings are discomfiting. Isn’t this matter to deal with seriousness and sincerity? The drop-scene is yet to reveal.
The apex court has ruled about fulfillment of its decision by January 10, 2012, and there are only four days to go before enticing forces meets unbending object. May be a better sense emerge in the power corridors.
