Islamabad: (Monday, January 09, 2012) Prime Minister Yusuf Raza Gilani today while commenting on Army Chief and DG ISI’s statements before the apex court said that any official action by a government functionary without the prior
approval of the government is unconstitutional and illegal.
Talking to the reporter of People’s Daily Online, he referred to the observation given by the Chief Justice of Pakistan Iftikhar Muhammad Chaudhary who had noted earlier that any government functionary without the government’s
nod is unconstitutional and therefore illegal.
The Prime Minister’s remarks were given in context of two particular issues, one relating to NATO attack on Pakistan’s western borders while the other one relating to the Memo written by Hussain Haqqani to the American authorities
regarding civil and military leadership of Pakistan and disclosed by an American citizen Mansoor Ijaz.
Referring to the first case, the PM said it was decided in a post incident meeting that the matter will be referred to the Parliamentary Committee on National Security that will decide on fate of the issue. In the second issue
as well, he said it was decided that the matter will be sent to Parliamentary Committee on National Security, however, resignation from Mr. Hussain Haqqani, the former ambassador to the US will be accepted.
He was of the view that it was only after both of the matters were referred to the Committee on National Security when the apex court decided to take suo motto action on the Memo case.
Pointing out the responses submitted by the Army Chief and Director General Inter Services Intelligence in the Supreme Court regarding Memo case, he said they do not contain the approval of the competent Authority as required under
the rules of business.
Elaborating what he meant by this, he said no summary seeking approval of the competent authority was initiated by the Defence Ministry, nor any approval was given by the respective authorities.
