As a layperson, I failed to understand the Option six of the apex court that it gave to the government on January 9, 2012, in the infamous NRO (National Reconciliation Ordinance) case.
It reads as, “Instead of insisting upon the executive to implement the judicial verdict and thereby running the risk of bringing down the constitutional structure itself, this court may exercise the judicial restraint and leave the matter to the better judgment of the people of the country or their representatives in parliament to appropriately deal with the delinquent”.
It is unclear that what the Supreme Court wants to say about handing over the matter to parliament. Will parliament pass any resolution in favor of the NRO implementation?
Nevertheless, the final authority is lies with the Constitution and its organs, the institutions lies with the people of Pakistan. There can be situation that people themselves be better suited to force a wayward to obey the rules and procedures.
It is worth highlighting here that more than half of the total parliamentarians have not spoken a single word on the floor of both houses, the National Assembly and Senate, in the last four years.
They are either to submissive to their party superiors or they do not have nerves to speak and lost their prerogatives.
What can one anticipate from them to get up and address with the remiss as mentioned by the apex court’s verdict?
Moreover, ‘free and fair polls’ is the key element behind the democracy. But, our history is full up with cooked up elections and results.
Fake voters, misconducts at polling stations, miscounting votes and use of force and violence are common examples in our ‘free and fair’ elections’. We should offer thanks to feudal mentality and similar traditions that forces people to vote for their candidates.
One would wonder that a free meal with free transportation or a worthless sum is enough to make people feel grateful to vote for the selected contender.
It is gloomy but true that Pakistan does not have a functional and efficient system of supremacy. The upcoming elections will be no different from past.
Considering the ground situation, should the apex court resort to Option six to resolve this very important case on disobedience of the Supreme Court verdicts.
