Supreme Court puts ISI, MI on notice

Accepting a plea to investigate the death of four out of 11 missing prisoners who had been allegedly abducted by intelligence agencies from outside the Adyala Jail following their release in 2010, the Supreme Court Wednesday issued notices to the chiefs of Inter Services Intelligence (ISI) and Military Intelligence (MI) and the Secretary Defence to explain the entire matter.

The apex court also directed Attorney General Maulvi Anwarul Haq to submit a reply from the federation on the matter by January 30.

A three-member bench comprising of Chief Justice Iftikhar Muhammad Chaudhry, Justice Khilji Arif Hussain and Justice Tariq Parvez was hearing the petition.

“It is a matter of grave concern that the dead bodies of the missing prisoners are found in hospitals and fields,” Chief Justice Iftikhar Muhammad Chaudhry remarked during hearing. The petition was filed by Advocate Tariq Hassan against the killing of four prisoners who were in the custody of security agencies.

The plaintiff prayed before the court that he had a video clip of those prisoners who were killed by severe torture. He told the court that 11 persons were picked by ISI, MI and IB after they were released from Adiala Jail.

Three out of four corpses were found in Lady Reading Hospital while the last one was recovered in a forest, located at the suburb area of provincial metropolis of Khyber Pakhtunkhwa.

The court adjourned the hearing until January 30 after the Attorney General sought some time for collecting the relevant details.

Earlier on December 9, the directors general of the ISI and MI conceded before the apex court that 11 missing prisoners of Adiala Jail were in their custody and were being tried under the Army Act 1952.

Raja Muhammad Irshad, the counsel for the Inter-Services Intelligence (ISI) and Military Intelligence (MI), told the court that the inmates were high-profile terrorists, who carried out terrorist attacks on army personnel and defence installations.
