CJ suspends membership of 28 parliamentarians

The Supreme Court of Pakistan has recently suspended the membership of a total of 28 parliamentarians of the country. This has been done because the parliamentarians were elected in their seats of the National Assembly as well as the Senate through by-polls
which took place after the passing of the 18th amendment.

The order that was given by the Chief Justice of Pakistan Iftikhar Muhammad Chaudhry  came after the resumption of a petition that was filed by the leader of Pakistan Tehreek e Insaaf, Imran Khan. The chairman and leader of the PTI had filed the petition
in order to request the apex court of the country to put a stop to the by-elections. Imran Khan had asked the by-elections to be blocked until the time that the electoral rolls were prepared by the Election Commission of Pakistan that show the voters list
minus the bogus voters.

According to the order of the Chief Justice of the Supreme Court, the memberships of the 28 parliamentarians will not be available till the time that the 20th amendment is passed. The passing of the 20th amendment would mean that the
parliamentarians have obtained the constitutional protection to carry on with their membership and the suspension would automatically be revived.

The Chief Justice of Pakistan commented on the matter in the following manner, “We are disappointed. The parliamentarians should themselves have refused the perks and privileges, saying the parliament was yet to legitimise their election. Our earlier order
was misconstrued and press conferences were held to condemn the verdict. The court had only directed that it must be ensured that voters lists are transparent and complete, which is a constitutional requirement.”

The members that have been suspended by the Supreme Court of the country include 16 members from the provincial assembly whereas nine members belong to the National Assemble. The remaining three members are the senators. The prominent members that have been
suspended include Finance Minister Abdul Hafeez Shaikh and Petroleum Minister Dr Asim Hussain. Other than that, the two suspended mnas are Jamshaid Dasti as well as Awais Leghari. These parliamentarians would have to wait until the 20th amendment
is passed.
