New Technologies and Energy Catala files a complaint against Apple, Inc. for abuse of public image

The U.S. firm had obtained an injunction to halt imports of the tablet manufactured by Valencian. However, eventually Apple lost the case which asserted on the infringing its patents that were allegedly directed at Valencian.
Now, Valencian company has fought back. According to Pedro Pelaez, co-owner of the company, Apple’s behaviour in this case is fully covered by the Spanish Penal Code such as extortion to the extent that said acts of intimidation to force a behaviour which is clearly damaging to the brand.
When they received the complaint from Apple, an expert examination was conducted, in which both companies agreed to establish whether the tablets should be marketed, officials at NTEC explained. However, Apple refused any such midways for an agreement. “They refused. They sought the destruction of the tablets imported and we stopped in production.” However, it is still argued that the tablet marketed by Valencia was totally different from Apple. According to the Valencian, Apple sent a comparative picture of the two tablets on which the iPad had suffered its touches to increase the likeness.
Despite winning the lawsuit, until this week the Valencian company has been on a list of importers accused of marketing products suspected of infringing patents. In fact, they have not recovered the 71 tablets held up in customs. Now they want those donated to non-profit organizations, and had to stop production of them. They recently received orders from China for more such products.
The Valencia-based company also reported to Apple at the National Competition Commission for abuse of dominant position. The customs blockade prevented the sale of the product in the holiday season. In the specialized blog Foss Patents reflected the conflict to discuss the concept of extortion.
