Apple loses to Samsung in Netherlands
Thursday, March 15th, 2012 6:21:19 by Farasat AliApple have succeeded in winning an appeal regarding the FRAND patent dispute with Samsung. Justice Holland has rejected Samsung appeal in the Dutch market to suspend the sale of Apple iPhone and iPad tablet because of a dispute
over a patent.
The court has ordered that Samsung can no longer pursue injunctive relief as long as Apple is open enough to negotiate a license agreement under FRAND terms for wireless patents. It has also been reported that Samsung are set to
supply the screen for new Apple iPad.
"(The) ruling by the Hague court provides Samsung with a legal basis to move forward with the protection of our patent rights. Samsung has and will continue to stand ready to meet its obligations in licensing its technology on
fair and reasonable terms." ," the South Korean firm said in a statement.
The two major companies that compete in the market for smart phones and tablets keep a handful of half-court litigation world, from Australia to the Netherlands, plus other individuals who are still standing with the authorities
of the European Union United States or China.
Apple started their patents in April 2011 when they were accused of copying Samsung designs for their tablets and mobiles with the arrival of the Galaxy range from Samsung. The initiation of lawsuits did not interfere; however,
there remained trade agreements between the parties for which Samsung provides details of their processors and screens to Apple.
Various sources in the business have ruled that Samsung cannot argue over Apple upon using their 3G patents illegally. Although the court itself tells the Koreans that they could claim some rights in products that use chips from
Intel. Samsung has announced that their activity will continue to protect their patent rights in court.
The fierce battle seems not to have affected their sales figures, as both Apple and Samsung have continued to sell even more products, before the registered complaints. With the release of the new iPhone on Friday, Apple will break
all sales records of tablets in one day which is an estimated one million.
