I think most of you must be familiar with the green lemon in the picture, which was the official logo of LimeWire, the popular file-sharing service, which experienced a lawsuit for copyright infringement in last May and eventually shutdown in October, 2011.
Recording Industry Association of America (RIAA) and 13 other record companies sued LimeWire and put an end to the free file-sharing (especially music) by LimeWire.
The Manhattan federal Judge Kimba Wood passed the decision of putting a ban on LimeWire. However, Wood was stunned by the claim of record companies that LimeWire should pay $75 trillion for the damage. The record companies have calculated the amount after
considering Section © 1 of the Copyright Act. According to the particular section, each instance of breach where two parties were answerable should be considered as violation of the policy. It means LimeWire should be held accountable for each instance of
infringement (i.e. the infringement damage should multiply the number of users who downloaded the particular file).
More than 11,000 songs were identified as “breached” material. Furthermore, each song was probably downloaded a thousand times. Hence, LimeWire should pay $400 billion to $75 trillion for the infringement damage.
Nonetheless, the claim of record companies has been labelled “absurd” by the same judge. She said, “You’re telling me. To put that number into perspective (I bet a lot of you didn’t even know "trillion" was a real number), the
U.S. GDP is around 14 trillion — less than one fifth of what the music industry is requesting. Heck, the GDP of the entire world is between 59 and 62 trillion. That’s right; the music industry wants LimeWire to pay more money than exists in the entire
world.”
Judge Wood allows a "single statutory damage award from Defendants per work infringed but still it will not be easy for LimeWire to pay hundreds of millions of dollars as more than 11’000 works are on the claim. It means LimeWire could still be accountable
for damages in excess of one billion dollars.
