Aitzaz Ahsan expresses dissatisfaction over the SC bench for contempt case

Prime Minister Yousuf Raza Gilani’s counsel in contempt of court case and a renowned lawyer, Barrister Aitzaz Ahsan on Wednesday expressed dissatisfaction over the Supreme Court bench appointed to hear the contempt case against Gilani.

The seven member special bench of Supreme Court headed by Justice Nasirul Mulk today, while hearing the case, insisted that it would not move an inch from the due course of law and would decide the case impartially.

But Aitzaz contended that the bench that issued notice and delivered verdict before the case was started, should not conduct proceedings as he doubts it could not conduct a fair trial. He further added that under the 18th Amendment, Article 10-A has been introduced that has radically changed the scope of law.

“It’s a revolutionary change,” the counsel observed, adding that fair trial and adopting due process of law is essential for a particular case. He elaborated that in criminal trial and even in contempt case, a person is entitled to fair trial.

“You mean that this bench is not competent to hear the trial,” Justice Sarmad Jalal Osmany asked Aitzaz. After the 18th Amendment, Aitzaz replied. Justice Osmany told the counsel that a bench that framed charges was also competent to hear the trial. “Trust us, we will be absolutely impartial,” Justice Asif Saeed Khan Khosa told Aitzaz, adding, “Never think that we could go an inch from due course of law.” Aitzaz replied that he too cannot go an inch from the evidences, he had submitted before the court.
