Ch. Nisar expresses dissatisfaction over speaker’s ruling

Opposition Leader in the National Assembly Chaudhry Nisar Ali Khan accused Speaker Dr Fehmida Mirza of misusing her authority by not sending a reference of disqualification against Prime Minister Syed Yousaf Raza Gilani to the Election Commission of Pakistan (ECP).

Lashing out at the speaker’s ruling, he said Fehmida Mirza has become a part of the group which is bent upon refusing the judicial verdict against Gilani in the contempt of court case.

Referring to the decision he observed, “We think that the NA Speaker has used her position wrongly and has not done justice”.

Chaudhry Nisar while addressing a press conference said that the premier was convicted by a bench of the highest court in the country, and thus stood disqualified.

He noted, “On one hand, seven judges have convicted Gilani of contempt of court while on the other hand, the Speaker National Assembly says there is no question of disqualification”.

Referring to a clause of the Constitution, he said any sitting member of the house is disqualified if he/she is convicted by a court.

The Opposition Leader further said that as per the law, the speaker should have sent the case to the election commission. “The ECP officials are neutral and the case should be reviewed by them,” he added.

He termed speaker’s decision weak, saying that the example of Makhdoom Javed Hashmi cited by her was not relevant at all. In his view, Hashmi was convicted by a lower court while the premier was convicted by the highest court in the country.

He continued saying Dr. Fehmida Mirza failed to provide solid examples in support of her ruling from Pakistan or any country across the globe.

In the meantime, the Leader of Opposition also proposed the names of three Chief Election Commissioner (CEC) nominees selected by him. The nominees include acting CEC Justice Shakirullah Jan, Justice (r) Fakhruddin Ibrahim and Justice (r) Nasir Aslam Zahid.

Pointing out that the nominees are only from Sindh and Khyber-Pakhtunkhwa (KP), he said he did not choose any from Punjab because then people would have accused him of favoritism.
