Are we heading towards a Judicial Dictatorship?

Pakistan is one of those unique countries that have faced basically everything since the day they were carved on the world map; from natural disasters to wars, military dictatorship, terrorism, political instability and so much more.

But now as democracy seems to be something that will continue and with the military struggling to sustain its own authoritative existence in the most backward of areas of this country, could the next phase be a judicial dictatorship?

For some, it might sound ridiculous but remember what Asma Jahangir said only a few months back that the country is heading towards a judicial dictatorship sounds right about now.

There are few instances in the world where the government and judiciary have had so many battles like in Pakistan and at the moment, it is still going on and has reached the climax. When things reach a boiling point when the courts themselves play out the role of judge, jury and executioner, there is little hope for anything else to run in a country.

Pakistan’s judiciary has never been so powerful and it has definitely become an example for other nations. No chief justice anywhere in the world is as powerful as ours today and that isn’t bad at all, until things get out of hand that is.

There is definite logic in the saying that “absolute power corrupts” and no matter how clean ones intentions might be, there is only so much that one institute should be able to handle before it begins to cross into the boundaries of others.

The surprising part is that whenever a military takeover takes place in Pakistan, the judiciary is the first one to legalise their actions. Same was the case with Pervez Musharraf who ruled the country for nearly 10 years without any legality in his government. How can one person be allowed to govern while committing high treason and the other be removed from the highest office in this country for a so called “contempt” of court by the same person and institution?

It just does not make any sense.

The only way this country can progress is by creating a base and building on that. It is great that the judiciary has become independent, but has it become independent of biasness and corruption? Instead of handling the matters of the extremely inefficient lower judiciary, the Chief Justice has begun dealing with how the government should run their matters.

We, as the people of Pakistan, need to set our priorities straight since we are the ones that elect our representatives and then celebrate when they’re thrown out of office.

    It is always daring to comment against the wrong doings of the high ups in the regime or system especially when the wrong doers are sitting in the superior courts and dragging the nation towards dark times for their vested interests and considering themselves holy cows by not allowing any body even to speak truth against their illegal decisions by sword of contempt of court. well done Mr. Hassan Bokhari, keep it up.
