Government of Pakistan making an attempt to gain immunity from court’s contempt

The government of Pakistan ruled by the Pakistan People’s Party is aiming to change a law in the constitution of the country that will grant immunity to federal as well as government leaders of Pakistan from being charged with contempt of court.

The attempt is being made in light of the problems that the government of Pakistan has been facing by the Supreme Court of the country. The work on the law started on Wednesday, July 4, 2012. Interestingly, the law that is in the making and to be passed
by the parliament of the country has stark similarities to the one that was drafted during the time that the Prime Minister of the country of Nawaz Sharif in 1997. The law was drafted to help Nawaz Sharif tackle with the problem that he was facing when the
Chief Justice of the country was Sajjad Ali Shah.

If the bill under the question is passed by the parliament of Pakistan, the federal and government leaders will have immunity from contempt of court under Article 248(1) as follows: “The President, a Governor, the Prime Minister, a Federal Minister, a Minister
of State, the Chief Minister and a Provincial Minister shall not be answerable to any court for the exercise of powers and performance of functions of their respective offices or for any act done or purported to be done in the exercise of those powers and
performance of those functions.”

The legal experts of the country are of the opinion that the drafting of the current law would escalate tensions between the judiciary of the country and the government. The Supreme Court of Pakistan recently held the former Prime Minister Yousuf Raza Gilani
in contempt of court for not obeying court orders. The Supreme Court of Pakistan had been asking Yousuf Raza Gilani to write to the Swiss probe in order to start an investigation against the President of Pakistan Asif Ali Zaradri as his name was involved in
the money laundering case. However, the investigation against him was brought to a close by the signing of the National Reconciliation Ordinance.

    Passing such bill will protect those who violates constitution and look down at law. I request all loyal Pakistanis including parliamentarians not to support this bill for sake of Pakistan. This bill will allow spies and agents in base of overseas loyal Pakistanis to rule, loot and run away. If they are loyal they should quash their dual nationality.
