NRO: Court orders the PM to write letter by August 8

Islamabad: (Wednesday, July 25, 2012) Hearing the NRO case here today, the Supreme Court has ordered the Prime Minister Raja Pervaiz Ashraf to write the letter to Swiss authorities to reopen cases against President Asif Ali Zardari.

Led by Justice Asif Saeed Khan Khosa, five-member bench, comprising of Justice Ejaz Afzal, Justice Ijaz Ahmed Chaudhry, Justice Gulzar Ahmed and Justice Muhammad Athar Saeed, heard the case.

While representing the government, Attorney General Irfan Qadir assured the court to make serious efforts to resolve the crisis. Earlier, the court had directed the PM to write the said letter to Swiss authorities by July 25 and
submit the compliance report.

Commenting on the case, Justice Khosa said that President Zardari is our president as well and if he enjoys global immunity then the court is ready to help in this regard.

Arguing the case, the AG said that court’s 12 July’s orders cannot be implemented as they contradicted the earlier judgment. He also said that a sitting prime minister was removed from his office unconstitutionally.

He said, “The NAB is not accountable before the court and that the NRO order has several flaws in it. The court has no jurisdiction over any NAB official and cannot issue direction to any of them.”

Building his argument, AG Irfan Qadir also demanded removal of Justice Khosa from the bench. Replying to which, Justice Khosa said that we are also not in favour of sending the Prime minister home, and that you should think of
ways to come out of the crisis.

Justice Khosa said that the court has taken its position in the NRO case and it cannot be readjusted, readjustment is only possible in politics.

Referring to the hope of a possible solution, the court order stated that the gap between two sate organs was not impossible and the honourable AG has assured to make sincere efforts to resolve the tussle. It stated that there
is a false tension among the institutions and the court hoped that by the next hearing a workable solution would be sorted out.
