Contempt of Court case to meet logical conclusion: Chief Justice Iftikhar Chaudhry

Chief Justice Iftikhar Muhammad Chaudhry on Monday said that the Contempt of Court case will be met logical conclusion whatever it might be.

A five-judge bench of the apex court headed by Chief Justice Chaudhry resumed the hearing of 27 identical petitions that challenged the Contempt of Court Act, 2012.

During the course of hearing, the chief justice said it has become a tradition in the country that courts were considered enemy after they give rulings against anybody.

The trend in the country was such that if a decision was in favour of a party, the party considered it fair, but if it was against that party, the same party considered it unjust.

He observed, “We become court’s enemy when it gives verdicts against us and it becomes good when its gives ruling in our favor”.

He further said that those who were convicted in contempt of court were given respect and greeted with flowers despite the fact they are enemy of justice in the country.

In his view, discussion in the media, civil society and judiciary over contempt of court law was a positive omen. The parliament and the judiciary were for the 180 million people of the country, he added.

Petitioners Rana Mohammad Jameel and Shahid Orakzai presented arguments in the court over the newly passed Contempt of Court Act 2012. The latter was of the opinion that the new law would have to be seen in the light of the Constitution.

Moreover, he said that it had endangered the Constitution. In his view, the new law should have been about enhancing respect for the judiciary.

He was of the opinion that the basic purpose of contempt law was to direct every individual to respect judiciary, saying that the new law has been imposed on provincial governments which was a violation of the Constitution.

Upon which, Justice Khilji Arif said the law had become applicable in the all four provinces and they had accepted it.

Earlier on Friday, the Supreme Court had observed that sparing powerful people by according immunity would only encourage a trend of not respecting the dignity and sanctity of courts and turn their orders into a mere piece of paper.

If one person was spared another would come to demand the same treatment, Chief Justice Iftikhar Muhammad Chaudhry had observed, “This will help encourage a trend of not accepting the dignity and respect of the courts and making our orders a piece of paper.”

    Analyzing the situation, the people of Pakistan having suffered the most, have come to this conclusion that it is a simple game of blaming each other and that the allegations are not unfounded. Therefore, it is imperative for both the judiciary and parliament to think calmly and resolve the issues amicably. Moreover, it is important that each one of the institutions refrains from encroaching into the other’s domain, comes out of an egotistical approach to save our country from ruination, and follows the maxim that ‘Respect returns respect.’
