The Samsung-Apple case is progressing inside the court but all kind of drama is being created outside. Samsung lead attorney John B. Quinn all up for a fight against Apple but now a new opponent has entered is to-do-list, Judge Lucy Koh.
On the day the trial opened in court, Samsung plead for the third time to present evidence that their smartphones like F700 all inspired from Sony’s handsets and were in the making in 2006, a year before the first iPhone was released. The judge rejected Samsung’ motion and Samsung’s prejudice on Judge’s inclination toward Apple cemented further more.
Samsung went on to deliberately release documents related to the case to the press. This might have been done to warn the court to some extent but there is still some chance that it may fire back on the Korean company.
Following is the excerpt from the company’s statements to the press:
“The Judge’s exclusion of evidence on independent creation meant that even though Apple was allowed to inaccurately argue to the jury that the F700 was an iPhone copy, Samsung was not allowed to tell the jury the full story and show the pre-iPhone design for that and other phones that were in development at Samsung in 2006, before the iPhone. The excluded evidence would have established beyond doubt that Samsung did not copy the iPhone design. Fundamental fairness requires that the jury decide the case based on all the evidence.”
