Apple nips the evil in the bud, wins the patent infringement case against Samsung – Part 1
Saturday, August 25th, 2012 5:22:09 by Usman KhalidApple won the historic patents infringement case against its biggest rival, the Korean electronics company Samsung Electronics at the District Court in San Jose, Northern California. The 9-member jury passed the final verdict penalizing Samsung with a total of $1.05 billion ($1,049,393,540 precisely) in intellectual property damages.
Samsung had filed a countersuit but did not receive a single dime as the jury verdict was almost unanimously in Apple’s favour.
Apple had filed the lawsuit in the district court in April and the proceedings started earlier in August. The jury finalized the decision quickly in less than three days after the closing statements from the attorneys from both sides.
The announcement of the decision came as a surprise to most as no one was expecting a quick decision on such a complex case that involved complicated patents and confusing to and fro attacks of evidence from both sides. One of Apple’s lawyers was seen in a polo shirt at the time of the verdict clearly showing that he was not at all expecting the decision on that day.
It is worth noting that the decision came on one day after a year, when Apple co-founder Steve Jobs stepped down as Apple CEO due to ailment. Another trivia is that the court is almost 8 miles apart from Apple’s Cupertino-based headquarters.
Many are of the opinion that the almost clean sweep by Apple has had a home court advantage. Samsung earlier partially won a South Korean-based patent infringement case against the same opponent.
Apple had filed the motion against Samsung on infringement of 7 of Apple’s patents in 28 of Samsung products including smartphones, in majority, and tablets. Apple had filed for damages in in tune of $2.75 Billion while Samsung asked for $421 Million in damages in case of a countersuit win.
