Apple wins billions in damages but Samsung is far from a retreat

Apple has won the legal battle against Samsung but the war is still raging. Many sources say that Samsung is expected to file an appeal against the verdict that found the Korean company guilty of infringing six of the seven Apple patents.

Though the verdict is out, the final decision is still to be made by federal judge of the US District court in San Jose, Lucy Koh. She has all the aces with her for now. The decision is set to be announced on September 20, when Ms. Koh might increase the penalty on Samsung and/or ban eight of its smartphones found in infringement of the patents.

She might also overrule the verdict, but that is most unlikely to happen, though Samsung will be praying for unexpected to happen. The nine-member jury, comprised of seven men and two women, passed the final verdict, declaring Samsung in wilful infringement of six of the seven filed patents by Apple. It also sought to ban eight of Samsung products in the US. In addition it fined Samsung with $1.05 Billion in damages, to be paid to Apple.

Though the new flagship smartphone, Galaxy SIII, was not in the list of infringements, Apple might add it for injunction on the sales of such products.

Both countries are fighting the legal battles in 10 countries and results have been a mixed cocktail for both. This is the first such verdict in the favour of one side. Apple is expected to receive a boost in sales in the US, should Judge Koh uphold the jury’s verdict.

There are also chances that other OEMs that manufacture smartphones and tablets running on Android will be inflicted by the damage, as the main reason behind the case was the operating system. However, some experts are of the opinion that the case was Samsung-specific and other companies like Motorola, HTC and ZTE will not be harmed to a bigger extent.

“These findings were specific to Samsung and not Android as a whole,” he said. “Apple would have to go after the others individually, and that’s a tall order.”
