Supreme Court summons Malik Riaz on September 17
Wednesday, August 29th, 2012 2:16:41 by Faisal FarooqRejecting his plea for seeking exemption from appearance, the Supreme Court on Wednesday summoned Malik Riaz’s on September 17 in the contempt of court case.
A two-member bench of the apex headed by Justice Ejaz Afzal Khan resumed the hearing from which the property tycoon Malik Riaz remained absent on account of medical treatment.
Counsel for Malik Riaz Advocate Dr Abdul Basit submitted a report before the court pertaining to ill health of his client.
According to the report, the property tycoon had a tumor and required a period of 11 weeks for undergoing treatment abroad.
He said, “My client was abroad for treatment even when the show-cause notice for contempt of court had been taken against him. He is seriously ill and that an operation to treat his ailment had become unavoidable”.
However, the petitioner and former president of the Islamabad High Court Bar Association Chaudhry Muhammad Ashraf Gujjar was not happy with the remarks of defendant lawyer.
He was of the opinion that the appearance of property tycoon Malik Riaz was necessary and his treatment was also possible in the country.
He also reiterated that the name of property businessmen should be placed on Exit Control List (ECL).
To this, Justice Ejaz Afzal said that every individual had the right to get treatment of their own preference, saying that a trial against Riaz could also be conducted in his absence.
However, the court directed Malik Riaz to must appear before it at the upcoming hearing of the case.
Moreover, the court asked the Attorney General Irfan Qadir to collect relevant evidences and submit to the court.
Earlier, Riaz had moved an intra court appeal challenging the issuance of the show-cause notice of June 13 and the July 13 order summoning the appellant for indictment.
On Aug 9, the Supreme Court had formally indicted Riaz on charges of levelling harsh allegations against Chief Justice Iftikhar at a press conference.
A two-judge bench framed the charges for committing contempt under Section 3 of the Contempt of Court Ordinance 2003, read with Article 204 (contempt) of the Constitution and the Supreme Court Rules 1980.
The court had taken notice of the June 12 press conference Riaz had addressed after his court appearance in which he hurled three questions at the chief justice.
