PPP will not write letter to Swiss authorities: Aitzaz Ahsan
Friday, August 31st, 2012 12:25:49 by Faisal FarooqReiterating his old stance, Pakistan Peoples’ Party (PPP) Senator Aitzaz Ahsan has said that the government would never write letter to Swiss authorities to reopen graft cases against President Asif Ali Zardari.
While talking to the media, the renowned jurist said it was impossible for any prime minister of the PPP to write against his party chief.
He asserted, “How is it possible that an incumbent PPP prime minister would write to Swiss government after the former was sent home for not doing so”.
He further said that the government would bring another premier if the Supreme Court disqualifies Raja Pervez Ashraf for not implementing its ruling in the NRO implementation case.
Aitzaz Ahsan, who was the counsel for disqualified premier Yousaf Raza Gilani, reiterated that President Asif Ali Zardari had complete immunity under the Constitution and the judiciary could not amend it.
He rejected the theory of middle way saying there will be no other way in the contempt of court proceedings against the incumbent prime minister as the apex court is bound to send chief executives homes in contempt cases like it did in the case of Gilani.
He asserted, “Either the PPP government or the court has to move back from their stated position. If Prime Minister Raja Pervaiz Ashraf does not write the Swiss letter, the court would have no option but to send him home”.
He asked how the court could give different decision in similar case as his client was disqualified for not writing a letter to the Swiss authorities.
He further said that a five-judge bench of the apex court could not adopt any other in the same matter in which a seven-member bench had disqualified a chief executive of the country.
He was of the opinion that the PPP government would not write letter to the Swiss authorities for reopening cases against his president.
He added that the court should also understand that as long as Asif Ali Zardari is the president of the country the letter could not be written to Swiss authorities.
In the last 500 years no state has presented its head in foreign courts, he added.
