Shoaib Suddle vows to deal Arsalan Iftikhar case on merit

Federal Tax Ombudsman (FTO) Dr Shoaib Suddle on Wednesday said that he would dead Arsalan Iftikhar case on merit and would not come under pressure from any side.

Speaking to the media, the bureaucrat said that all institutions were bound to obey rulings of the Supreme Court under article 190.

Pledging that he said will play an impartial role in dealing with the case and won’t take pressure during the probe.

Earlier, the apex court ordered Nation Accountability Bureau (NAB) to hand over the available record to the commission.

Suddle summoned a meeting to finalize the framework in consultation with law experts to investigate corruption case against Arsalan Iftikhar, who is son of Chief Justice Iftikhar Muhammad Chaudhry

He was appointed as one-man commission set by the Supreme Court to investigate Malik Riaz’s charges against Arsalan Iftikhar.

Suddle, who is a former senior police officer, said he would first read the court order to see what he has been tasked to investigate.

“The Supreme Court appointed me as commission without my prior consent or any indication about it before hand. I came to know about it after the judicial order while I was abroad”, he added.

As per the August 8 ruling of the court on the review-petition of Arsalan Iftikhar, the commission will probe into the culpability of Dr Arsalan, Malik Riaz, his son-in-law Salman Ali Khan and all those others who may be found involved in criminal activities in the light of the June 14 judicial order.

It will also ascertain such facts as may be relevant, connected with or ancillary to the determination of the foregoing matters and to set the machinery of the State in motion so that all those who may have committed illegal acts are pursued and brought to book with the full force and rigor of the law.

The commission shall exercise all the powers envisioned in the Supreme Court Rules, 1980 and the powers of judicial officers for the purpose of carrying out the objects mentioned in the order.

It will be free to avail the services of advocates, experts of forensic science, persons with relevant experience, including fiscal laws etc.

    Finally the love takes over the duties and Chief Justice the so called man of principles started playing tricks to save his son. Setting up of another (one-man this time) commission to investigate will again become controversial just as the setting up of the Memo Commission by the SC troubled many legal minds. Fingers may now be pointed that this is another case of the SC assuming to itself the powers of an investigation agency, which it is not mandated to do, and which is the exclusive preserve of the executive. Such commissions of inquiry are normally set up by the government under the Commissions of Inquiry Act. This new ‘jurisprudence’ by the apex court is bound to arouse controversy, possibly face legal challenges, and reinforce the opinion that holds that the SC is either unable, or seen to be unable, to do impartial justice in a case involving the CJ’s son. For this negative perception, the SC has no one to blame but itself.
