Supreme Court gives three months to complete land survey in Karachi
Wednesday, October 31st, 2012 1:04:23 by Faisal FarooqExpressing dissatisfaction over the provincial government, the Supreme Court on Wednesday ordered the authorities concerned to complete the survey of government lands in Karachi in three months.
A five-member bench of the court headed by Anwar Zaher Jamali resumed hearing of the Karachi law and order case at Supreme Court’s Karachi Registry.
Last year, the apex court had given its detailed verdict in the case after Chief Justice Iftikhar Muhammad Chaudhary had taken suo motu action on the security situation in the city.
During today’s proceedings, Justice Anwar Jamali said that the government does not need any court ruling to conduct the land survey and in fact it was the duty of the government to protect its lands.
Upon which, Advocate General Sindh Abdul Fateh Malik told the court the task that was pending for the past seven years, has been accomplished by the chief secretary in only one day.
Chief Secretary Sindh Raja Ghulam Abbas informed the court that he had got the approval of the survey from Chief Minister Sindh Syed Qaim Ali Shah.
Another judge, Justice Amir Hani Muslim said that the entire land from Gadap to Jamshoro and the area around the Super Highway is government’s property that has been encroached.
Advocate General pleaded for a year’s time to complete the land survey, however, the court granted three months to conduct the survey by utilizing latest technology.
Justice Anwar Jamali was of the opinion that the revenue record was deliberately burnt as the influential people who have grabbed the government’s land do not want that the survey should be conducted.
In the course of hearing, Justice Anwar Zaheer Jamali also ruled out that all unregistered cars and motorcycles in the city should be seized.
He said that cars are seen being driven around without bearing any registration number plates, questing how unregistered cars without fitness certificates even make it to the roads. He opined that the economic activities in Karachi have almost become zero due to the declining security situation.
In the last hearing, the bench had remarked that the encroachments and land grabbing were the main reasons behind the unrest in the city.
The court had also issued the contempt notices to Chief Secretary Sindh, Director Master Plan Karachi Metropolitan Corporation (KMC), senior member of Board of Revenue and Director Survey.
