Ruling on Balochistan government stays intact: Supreme Court
Friday, November 2nd, 2012 2:34:30 by Faisal FarooqThe Supreme Court of Pakistan on Friday has said that its verdict of 12th of this month on Balochistan government stays intact, directing to take urgent steps for the early recovery of missing persons.
A two-member bench of the apex court headed by Chief Justice Iftikhar Muhammad Chaudhary resumed hearing of the case pertaining to the law and order situation in Balochistan.
Attorney General Irfan Qadir read out the interior secretary’s report on the Balochistan issue, saying that the entire matter began after Akbar Bugti was killed and that those involved in his killing were responsible for the issues faced by the province.
The report stated that the government was fully aware of its duties, adding that, it was taking a number of steps to improve the security situation in Balochistan. It added that it could not be said that the provincial government had failed.
It further asked whether the court was declaring a state of emergency in Balochistan, adding that, only the president had the authority to do so.
After the report was read out, Chief Justice Iftikhar remarked that the Balochistan government was answerable to what was happening in the province.
The chief justice moreover asked whether it was possible for people to freely move in the province.
He continued that the province was going towards elections in two months, adding that the Balochistan court had accepted that the province was a victim of distractions since 2006.
Chief Justice Chaudhary in the course of hearing remarked that the court had ordered for elections so that the situation in the province would improve. He also asked the attorney general to say whatever he wanted to in a written statement.
The attorney general also stated that the Balochistan issue apart from law and order situation had political motives as well.
Upon which, the chief justice asked if there was a bigger injustice than the chief minister’s own nephew being killed.
Criticizing the attorney general, he said that while the governor, chief minister and chief secretary were being attacked, he sat in Islamabad thinking everything is fine.
Saying that harsh realities of life need to be accepted as well, the chief justice added that resolving issues requires effort. The hearing of the case was then adjourned till November 20.
Earlier, the court announced in its interim order that the Balochistan government had failed in maintaining the law and order situation and protecting the lives and properties of its people, which is the principal constitutional responsibility of any set-up.
