Supreme Court Discards Musharraf’s Review Petition

It was reported from Islamabad that Supreme Court, on Thursday morning, totally disposed off the review petition filed by the former military ruler of Pakistan, General (Retd) Pervez Musharraf. This petition was against the July 31, 2009 and November 3, 2007 where he declared emergency.

A 14-member bench headed by Chief Justice Tassaduq Hussain Jilani decided to unanimously dispose of the petition. They claimed that the plea was not based on any merit and the arguments presented were absolutely irrelevant.

Musharraf’s advocate, Sharifuddin Pirzada, claimed that several unconstitutional steps were taken in the country’s past and judiciary had allowed it to happen over the course of these years. He gave the example of Canada and India where emergency was imposed.

He was questioned whether Article 6 was applicable in Canada to which he responded that apart from Canada several other countries do apply Article 6. He also stated that the judge should remain impartial and should pass judgements without accepting any influence.

Musharraf filed a petition after a delay of four years on December 23, 2013. He wanted to seek review of the landmark July 31, 2009, but it was returned back by the court.

The review petition also argued that the former elected prime minister of Pakistan, Shaukat Aziz, recommended to take extra-constitutional measures of proclaiming the November 3rd emergency.
