Gulshan Superstore Gets Legal Approval

Stores on the Gulshan- i -Iqbal received a court order to close all stores along that route due to the intensity of traffic they cause when customers park along the road to go to the stores. However, Sindh High Court passed a ruling on Monday that the Imtiaz Superstore should resume business.

Imtiaz Hussain owner of the store appeared before Chief Justice Sajjad Ali Shah pleading that his store should be allowed to open.

Hearing his plea the court had averted its ruling of having the stored closed entirely to having it open till 3:30pm on a daily basis. This is to help reduce the traffic jam that is found along that route between the hours of 3:30pm to 9:30pm. The Rashid Minhas Road is well known for its severe traffic conditions during the rush hour.

Imtiaz Hussain went further to explain that the court order had stated that the stores should remain close until solutions can be found in reducing the traffic intensity around the area. In addition, the court had also stated that the store could only remain open if it is able to provide parking space which has to be approved and a transport and communication officer for its customers that will not obstruct the traffic. Any parking plan developed has to be in accordance with the Karachi Metropolitan Corporation.

He raised concerns that after fulfilling all the conditions, the superstore in Gulshan-i- Iqbal is still expected to close at 3:30pm.

On the other hand, the police and the city administration claims that the store obstructs the traffic as the customers park their vehicle on the road and this jams the traffic during rush hours.

The owner of the store pleaded that his business will not make profits if the store is closed during the time it is expected to close because it is during rush hours that more customers come in to buy things. He also stated that he had provided parking space that can contain up to 300 vehicles.

After hearing the petitions of Imtiaz, the chief justice questioned the city administration on the reasons why the store should be held responsible for causing the traffic? He stated that it is the job of the administration to handle all traffic problems.

In his remarks, the chief justice spoke of the existing illegal parking fine and vehicle lifting that should be of use to control the traffic situation.

Before the hearing was adjourned to another date, the chief justice requested the Additional Advocate General Barrister Mustafa Maheser to see to it that the plans of the parking space drawn for the superstore as approved by the Building Control Authority should be put into the record for further examination.
